Tourism Fiji SUN-SET Online Promotion



  1. This Tourism Fiji SUN-SET Competition ("Competition") is conducted by Fiji Visitors Bureau, ABN 71245718806, of Suite 1204, Level 12, St. Martins Tower, 31 Market Street, Sydney, NSW, 2000, Australia ("Promoter") in all states excepting NSW where it is conducted by Circul8 Communicate Pty Ltd, ABN 11 123 609 049, L1 545 South Dowling Street, Surry Hills, NSW, 2010 ("Promoter").


  1. For the purposes of the Competition, each of the following is a Region:
    1. Australia;
    2. Africa;
    3. Hong Kong;
    4. Europe comprised of Italy; The Netherlands; Norway; Spain; Sweden; Switzerland; Finland; Denmark; Portugal; France; Germany; Ireland and the United Kingdom;
    5. Americas;
    6. Canada; and
    7. New Zealand.


  1. Unless indicated otherwise in these conditions, these conditions apply to all Regions.
  2. Entering the Competition constitutes acceptance of these conditions.
  3. The Competition is only open to Eligible Entrants.
  4. An "Eligible Entrant" is an individual who is:
    1. Not an employee, officer, servant or contractor of the Promoter or any organisation associated with the Competition or provision of the prize, or their related bodies corporate or associates or any of their agencies involved with the Competition;
    2. Not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee or other person as described in clause 6 (i) above;
    3. A permanent resident of a country within a Region; and
    4. Aged 18 years or over
  5. All relevant instructions on the Promoters' website (if any) form part of these conditions


  1. Entry to the Competition opens at 09.00am AEST on 27 October 2014 and ends at 11.59pm AEDT on 13 January 2015. ("Entry Period").


  1. An Eligible Entrant can only enter the Competition by complying with each of the following requirements:
    1. Visiting
    2. Watching the video for the full one minute
    3. Entering their full name, email address and country, or clicking on 'Facebook Connect'
    4. Agree to comply with these conditions of entry
    5. Read and accept the contents of the Tourism Fiji Ltd Privacy Statement.
  2. After the initial entry an Eligible Entrant is eligible to submit an additional entry for the Prize draw for each Share via Facebook, Email or Twitter.
  3. There is no limit as to how many times an Eligible Entrant enters the Prize draw.
  4. All Eligible Entrants must ensure that their entries are received by the Promoter during the Entry Period. Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect inaccurate or incomplete information either caused by website users or by any of the equipment or programming associated or utilised in this Competition, or by any technical error that may occur in the course of administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of Entries.
  5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.


  1. The nominated draw mechanism operated by Traction Digital will undertake a Prize draw in accordance with clause 15.
  2. The draw will take place at 1.00pm (AEDT) at the office of Traction Digital; Digital Village, Level 1, Building 1, 85 O'Riordan Street, Alexandria, NSW, 2015, Australia on 14 January 2015.
  3. The first valid Entry drawn will be the winner ("Winner") of the prize ("Prize") comprising of;
    1. Return tickets to Fiji for 2 with Fiji Airways from any Fiji Airways destination route (airline subject to change due to availability and time of booking).
    2. 4 nights accommodation in an Island Bure at Castaway Island Resort, including breakfast, lunch and dinner, (food only - alcoholic and non-alcoholic drinks not included) complimentary use of non-motorised water sports equipment and a Dolphin Safari speedboat trip for 2 people (subject to availability and weather conditions).
    3. 4 nights accommodation in a Beachfront Bure at Likuliku Lagoon Resort, including breakfast lunch and dinner (food only - alcoholic and non-alcoholic drinks not included), welcome refreshment, daily Likuliku special amenities and complimentary use of non-motorised water sports equipment.
    4. 4 nights accommodation at Matamanoa Island Resort, including breakfast, lunch and dinner (food only - alcoholic and non-alcoholic drinks not included), and complimentary use of non-motorised water sports equipment.
    5. Ground transfers to and from the airport/Port Denarau
    6. Sea transfers between the resorts
  4. There is a total maximum Prize value of AU$22,223.27 (FJ$37,560) based on a conversion rate of FJ$1 : AU$0.591674 (
  5. All accommodation is subject to availability. Castaway Island accommodation may not be taken during peak periods such as school holidays.
  6. If the Winner lives outside of the Fiji Airways route map they will be provided with:
    1. Two return economy airfares from their closest capital city airport to an airport within the Fiji Airways route map up to the maximum total value of FJ$17,000 (airline subject to change as described in clause 16 (i)).
  7. Meals and Transfer fees (other than those specified above), tips, domestic travel to and from departure point, taxes that are not included in the airfare and other personal expenses and travel insurance must be paid for by the winner.
  8. The Prize is valid from 14 January 2015 for 12 months.
  9. The Winner will be notified by email on 14 January 2015 and their names published on and on the Tourism Fiji website. The Winner will also be published in The Australian newspaper at the end of the Competition on 16 January 2015.
  10. The Winner has three months to claim the Prize. If the Winner does not then a new Winner will be drawn. The Promoter reserves the right to redraw any draw in the event of any Eligible Entrant not claiming the Prize. If the Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw for all unclaimed prizes, at the same time and place as the original draw, on 14 April 2015. The redraw Winner will be notified by email and also be published in The Australian newspaper.
  11. The Winner is recommended to book as early as possible to ensure travel as early as possible. The prize cannot be refunded for cash or transferred and cannot be used in conjunction with any Frequent Flyer programs. Frequent flyer points will not be provided. The prize does not include any other travel costs to and from the winner's city of residence to Adelaide, Brisbane, Darwin, Melbourne, Perth, Sydney. All components of the Prize must be taken together. Airline tickets must be used in conjunction with the trip, over the specified routing in the stated class of travel. Travel restrictions may apply.
  12. If for any reason the Winner is unable to accept the prize as stated for the dates indicated, the winner will forfeit the prize and no compensation will be given in lieu. If any part of the Prize is unavailable, the Promoter, in its sole and absolute discretion, reserves the right to substitute the Prize (or that part of the Prize) with any alternative prize.
  13. It is the Winner's personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers. The Promoter makes no representation as to the safety, conditions or other issue that may exist at any destination. Cash will not be awarded in lieu of the Prize or element thereof, unless stated.


  1. If drawn as the Winner an Eligible Entrant must deliver to the Promoter (by a means determined by the Promoter) evidence of any documents the Promoter may request establishing eligibility (as described in clause 6 (i), (ii),(iii),(iv)) to enter and win, including evidence of residence and photo identification. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an Eligible Entrant must deliver requested copies within 7 days of being asked to do so.
  2. The Promoter may, at its absolute discretion, declare any or all entries made by an Eligible Entrant invalid if the Eligible Entrant: (i) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or (ii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iii) in the Promoter's opinion, submits an entry which is not in accordance with these Conditions.


  1. If an Eligible Entrant breaches their obligations under these Conditions or any agreement with the Promoter, the Promoter may determine that the Eligible Entrant has forfeited their Prize.


  1. The Promoter takes no responsibility for the value of the Prize depreciating between the start of the Competition and receipt of the Prize.
  2. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
    Any changes to the Competition and/or Terms and Conditions relating to the promotion (including prize variations, cancellation or suspension of your promotion), is subject to the approval of all relevant State and Territory Lottery Departments.
  3. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Promotion (whether as a result of one of the foregoing causes or otherwise).
  4. All of the Promoter's decisions are final and no correspondence will be entered into.
  5. The Promoter accepts no responsibility for any tax liability incurred as a result of an Eligible Entrant participating in the Competition. Eligible Entrants should obtain independent tax and financial advice.
  6. Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded.
  7. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Promotion or its prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an Australian Entrant's rights under the Competition and Consumer Act 2010.
  8. Each Eligible Entrant agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed.
  9. Each Eligible Entrant grants the Promoter and its associated entities an exclusive, royalty-free, irrevocable, perpetual, worldwide and transferable license (including the right to sub-license) to use such footage and photographs for promotional and marketing purposes, including online social networking sites.
  10. If any provision of these conditions is held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions, which shall continue in full force and effect.


  1. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise it's Winner. The Promoter will not sell personal information to other organisations. The personal information of the Winner may be provided to others assisting in the conduct of the Competition, including prize suppliers and deliverers. Persons may contact the Promoter by communication addressed to "Legal Counsel" at the address in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win the Prize.
  1. The laws of Australia apply to the Competition to the exclusion of any other laws. Eligible Entrants submit to the exclusive jurisdiction of the courts of Australia.
  2. The Eligible Entrant agrees to indemnify the Promoter and its associated entities, officers, employees, and agents against all liabilities, expenses, losses, claims, damages and costs arising out of or in connection with:
    1. The Eligible Entrant's participation in the Competition; or
    2. The use of the Eligible Entrant's Entry

Privacy Policy

Tourism Fiji (TF) is the Fiji Government statutory authority responsible for international and domestic tourism marketing

TF understands that privacy & proper handling of personal information is important to you and our private policies are based on respect for international standards of information privacy protection. This also applies to TF’s handling of personal information across all its offices (in Fiji and internationally) online and offline.

1. What Personal Information Does TF Collect?

The types of personal information that we collect will depend on the nature of your dealings with us. For example, we may collect personal information directly from you when you:

  • subscribe to a newsletter or register to receive brochures (eg through TF's website);
  • apply to attend or exhibit at a TF event, or enter a promotion at such an event;
  • register to participate in the Matai Specialist Program;
  • Have business dealings with us (whether as an employee of one of our external service providers, or if you work for a Government agency we deal with, or in the context of a transaction, or if you volunteer personal information to us).

In each case, we only collect the personal information that we need to carry out our specific functions. For example:

  • if you are a travel agent who registers for the "Fiji Matai Specialist Program" through our website, we will collect your name, gender, date of birth, job title, email address and business contact details;
  • if you are a traveller or tourist who registers to receive electronic newsletters from us we will collect your name, address, email address, age group and information about what type of holiday you are looking for. This is so we can make sure we can provide you with material which is likely to be of the most interest to you; and
  • if you deal with us in the course of business, we will generally only collect your business contact details (so we can communicate with you for normal business purposes).

We also collect personal information about our employees and contractors (personnel records). Details about the personal information contained in personnel records and in other records held by TF are contained in TF's entry in the Register of Personal Information Digests, maintained by the TF.

2. How do we use Personal Information?

We need to collect personal information so that we can provide you with the publications or services you have requested, or so that we can carry out specific statutory functions (or both). The particular purpose for which we collect personal information will either be explained when we collect that information, or will be obvious from the context in which it is collected. Under the IPP's, we must only use personal information for the particular purpose we collected it for, or for other purposes that are directly related to that purpose. If we want to use personal information for any other purpose we must obtain your consent. If we use your personal information to send you information by email (including e-newsletters), we will always give you an opportunity to "unsubscribe", and we will respect your wishes.

3. Will Your Personal Information be Given to Anyone Else?

TF makes only limited disclosures of personal information. Examples of these disclosures are explained below. TF does share personal information that it has collected in the course of conducting trade events with other Fiji Tourism stakeholders. These authorities are Fiji Hotels Tourism Association, Fiji Tour Operators, Fiji Scuba Diving Association. Such disclosure is notified when that personal information is collected. We may also disclose personal information to external service providers who help us operate our business (eg Website/IT consultants, publishing houses). If TF engages external service providers, we require those contractors to comply with contractual privacy obligations that reflect TF's own strict privacy obligations under the IPP's. In the context of International Media Trade Visitation Program (IMTVP) and Fiji Matai Specialist Program, personal information may only be disclosed with the consent of participants in that program. For example, with consent, personal information about participants may be disclosed to organizations involved in the Fiji tourism industry such as airlines, hotels, tour operators and product suppliers. However, there will be no disclosure of this personal information without consent. Otherwise, TF will only disclose personal information with your express consent, or if this is required by law or permitted under the Privacy Act. One example of where disclosures may be required by law will be where a request is made under the Freedom of Information Act of Fiji. However, if access is sought to a record containing your personal information by a third person, FOI Act procedures that are designed to protect your privacy will apply.

4. Security of Personal Information

TF takes security of personal information seriously. Most electronic records of personal information collected by TF are stored in databases are hosted on servers in Fiji. Some records (relating to consumers) are stored in databases that are hosted on servers in our overseas offices. In each case, our IT systems are protected by appropriate IT security measures. If you do not live in Fiji, and we want to store your personal information on servers that are located in Fiji, we will generally ask you to consent to this at the time we collect personal information from you. If you don't want your personal information to be transferred to Fiji, please don't provide us with your personal information. If you have dealt with TF in the past, and don't want your personal information stored in Fiji, you can ask to be removed from our databases at any time (using the contact details at section 7 below). We also require our staff to ensure that paper records containing personal information are stored securely. TF’s personnel are bound by confidentiality obligations as a condition of their employment, and this extends to ensuring that personal information collected by TF is kept confidential.

5. Access and Correction

Under the Privacy Act, you have the right to seek access to the records of personal information that TF holds about you. You also have the right to ask us to alter your personal information to ensure it is accurate and up to date. If you wish to access the personal information that we hold about you, please set out your request in writing, and forward this to our Administration Department, using the contact details set out at the end of this Privacy Policy.

6. Online Privacy Issues

If you use TF’s websites, you are understood to consent to the terms and conditions set out on our websites. This includes consenting to the terms of this privacy policy. In general, you can visit TF’s websites without telling us who you are or revealing any personal information about yourself. However there are times when we may need to collect personal information from you. For instance, if you register to receive our publications or to attend an event, we will need to collect some personal information from you. At the time of collection, we will seek your permission to send you further electronic communications, and for your personal information to be stored in databases that are hosted in New Zealand. If at any time after submitting your personal information to us you would no longer like to receive information from us, simply follow the "unsubscribe" directions at the end of any email communications you receive, or contact us using the contact details at section 7 of this External Privacy Policy. No attempt will be made by TF to identify website users or their browsing activities except in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect server logs. The statistics and log files may be preserved indefinitely and used at any time and in any way necessary to prevent security breaches and to ensure the integrity of the information supplied by TF.

In general on TF’s websites, IP addresses (the Internet address of a computer) are logged to track a user's session while the user remains anonymous. We analyze this data for certain trends and statistics, such as which parts of our site users are visiting and how long they spend there. We do not link your IP addresses to anything that identifies you. In those limited cases where session information is not anonymous, TF will provide notice of the practice and an opportunity to "opt out".

When we receive information about your session or about you, we may also use it for research or to improve our site and the services we offer you.

a) Cookies

Some TF web pages use "cookies", which are small files that may be placed on your hard disk for record-keeping purposes. A cookie helps us remember who you are. Cookies can make your subsequent visits to the web page simpler and more seamless. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. (However, by not accepting cookies, some web pages may not display properly or you may not be permitted to access certain information.) A server cannot find out a name or email address, or anything about a user's computer, by using cookies.

b) Online Security

TF strives to ensure the security, integrity and privacy of personal information submitted to our sites, and periodically updates its security measures in light of current technologies.

You need to be aware of inherent risks associated with the transmission of information via the Internet. TF cannot guarantee or warrant the security of any personal information you submit to our sites. If you have concerns in this regard, TF has other ways of obtaining and providing information. Normal mail, telephone and fax facilities are available.

TF sites may also be linked to websites operated by third parties. These links are meant for your convenience only. Links to third party sites do not constitute sponsorship or endorsement or approval of these sites. Visitors to those sites should refer to their separate privacy policies and practices.
